Welcome to TabWatch! These Terms of Service ("Terms") govern your use of the TabWatch application and any related services provided by us. By accessing or using our service, you agree to be bound by these Terms.

1. Description of Service

TabWatch is a classroom management tool designed to help teachers monitor student activity on their web browsers during class. The service consists of a web-based dashboard for teachers and a browser extension for students. The extension periodically captures screenshots of the student's active browser tab and displays them on the teacher's dashboard.

2. User Accounts

Teachers: To use TabWatch, teachers must authenticate using a valid Google account. By doing so, you grant us permission to access your Google Classroom courses and rosters to facilitate classroom monitoring.

Students: Students are required to install the TabWatch browser extension. The extension will be active only when a monitoring session is initiated by an authorized teacher for a specific class.

3. Licensing and Subscriptions

Mandatory Individual Licenses: Each individual teacher using the TabWatch Observer dashboard must be covered by an active license through either a school or department-level subscription. Sharing account credentials or whitelisting multiple distinct teachers under a single departmental seat is a strict violation of these Terms.

Cost Justification: TabWatch maintains a fair pricing model to sustain the significant recurring infrastructure costs required to serve high-frequency classroom images, provide secure cloud storage for snapshots, and maintain real-time database synchronization for active monitoring.

4. Privacy and Data

Your privacy is important to us. Our use of your data is governed by our Privacy Policy. By using TabWatch, you agree to the collection and use of information in accordance with that policy.

The TabWatch extension only captures the content of the student's active browser tab. It does not capture other tabs, other applications, or the student's desktop. All captured data is transmitted securely and is only accessible by the authorized teacher of the corresponding class.

We do not share your personal information or student data with third parties, except as required by law.

5. Acceptable Use

You agree not to use TabWatch for any unlawful purpose or in any way that could harm the service or impair anyone else's use of it. Prohibited actions include:

• Attempting to gain unauthorized access to other user accounts or our systems.
• Interfering with the security or functionality of the service.
• Using the service to monitor individuals outside of an official educational context without their consent.

6. Termination

We may terminate or suspend your access to our service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

Upon termination, your right to use the service will immediately cease. Teachers may request the deletion of their account and associated domain data by contacting us.

7. Disclaimer of Warranties

The service is provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, express or implied, regarding the operation or availability of the service.

8. Limitation of Liability

In no event shall TabWatch, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the service.

9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
